Non-Compliance for Unfiled Tax Returns

Many of our clients come to us with several years of unfiled tax returns. They thought they didn’t need to file or they fell behind due to adverse circumstances. Now they have begun to grow worried that the IRS might take aggressive action or they have received an IRS notice requesting or demanding a missing year. Some are about to get married; others have applied for a job that requires them to be compliant with the IRS. Audit Defense

Accelerated Tax Solutions has a legal team dedicated to audit defenses and reconsiderations. Did you leave your home sale or gambling earnings off your tax return? Did your tax preparer overstate your expenses? Has the IRS questioned expenses on your Schedule C for your sole proprietorship? Don’t worry! Offer in Compromise (OIC) or Fresh Start Program

Previously called the Fresh Start Program, an Offer in Compromise is an agreement between a taxpayer and the IRS that settles the taxpayer’s tax liabilities for less than the full amount owed. The OIC is a great program for the right candidate. Our experienced staff of tax professionals will gladly discuss all the options you may qualify for. The IRS may consider an OIC based on three grounds:

  1. Doubt as to Collectability – Doubt exists that the taxpayer could ever pay the full amount of tax liability.
  2. Doubt as to Liability – A legitimate doubt exists that the assessed tax liability is correct.
  3. Effective Tax Administration – There is potential for the IRS to collect the full amount. However, an exceptional circumstance exists that would cause the taxpayer to suffer economic hardship or be unfair and inequitable.

A Note about Offers in Compromise: Clients often report that they have heard companies claim they can reduce their tax liability to pennies on the dollar. If clients do qualify for these types of agreements, Accelerated Tax Solutions is quite experienced handling them. However, we don’t dangle these offers in front of our clients in what amounts to a bait and switch as many firms do. The IRS warns, “unscrupulous companies [engage in] scams commonly called OIC ‘mills’, which cast a wide net for taxpayers, charge them pricey fees, and churn out applications for a program they are unlikely to qualify for. In 2019, there were 54,000 OICs submitted to the IRS. The agency accepted 18,000 of them.”

Release and Prevention

If necessary, one of our very first moves is either to seek a release or reduction of existing garnishments or levies or to prevent the IRS from garnishing your wages or placing a levy on your bank account or lien against your property. Our attorneys will work swiftly to demonstrate that the action has either created a significant economic hardship or violated the statute of limitations, or they will negotiate an agreement that will include a release of the levy and prevent future adverse actions by the IRS.

Installment Agreements

There are a variety of installment agreements available that when properly implemented will allow you to repay your tax liability in a comfortable and manageable way. Innocent Spouse can release your responsibility for paying tax, interest, and penalties if your spouse (or former spouse) improperly reported items or omitted items on your tax return.
